Last updated: 5 September 2026. Model terms for the website under development. Items marked ‘Proposal for validation’ are commercial suggestions, not yet approved by the client or confirmed at checkout. They must be reviewed before commercial launch. Consumers' statutory rights do not depend on that validation.
The Terras da Gama store identifies its operator as Sociedade Agrícola Terras da Gama, with contact address at Rua de São Bartolomeu n.º 14, 6120-030 Vale da Gama, Portugal. Email: carlosimoes.terrasdagama@gmail.com. Telephone: (+351) 919 794 779Call to a Portuguese mobile network
To be completed: exact legal company name, NIPC, registered office and applicable commercial registration details. The returns address must be confirmed before the final version.
These terms govern online sales of products to consumers. Bookings for visits or experiences, if offered, must have specific terms presented before the contract is concluded. The intended contractual language is Portuguese.
Essential characteristics, quantities, volume, alcohol content, ingredients and applicable allergens must appear on the product page or in the information legally required before purchase. Consumers should consult that information and follow storage instructions.
Prices are displayed in euros, including applicable taxes. Shipping and other mandatory charges must be itemised before payment is confirmed. No additional charges are made without prior information and acceptance.
Availability must be confirmed when processing the order. If a product is unavailable, the customer will be informed and any amount paid for the undelivered product refunded in accordance with the law. No product will be substituted without agreement. Subsequent price changes do not affect contracts already concluded.
Alcoholic beverages are sold exclusively to people aged 18 or over. The purchaser must meet this requirement, and alcohol must not be delivered to minors. Where necessary, proportionate proof of age may be requested without excessive data collection.
Proposal for validation: an age-verification procedure at checkout and delivery, coordinated with the carrier. A written notice does not replace the implementation of these checks.
Select your products, review your basket, enter the required details and choose from the available delivery and payment methods. Before completing the order, you must be able to correct errors, see the total and consult these terms.
The final confirmation must clearly state that the order entails an obligation to pay. The customer must receive contractual confirmation and legally required information by email, including the terms and withdrawal information, on a durable medium.
Proposal for validation: the automatic notification confirms receipt of the request; contractual acceptance is expressly communicated by email after availability and payment have been checked. Before the final version, this process must match the actual WooCommerce messages and statuses.
Proposal for validation: offer Multibanco, MB WAY, debit or credit card and bank transfer, depending on the contracted providers. This list does not confirm that these methods are already active. The final version must list only those actually available.
Proposal for validation: a 48-hour payment period for payment references and transfers, with notice to the customer before cancellation for non-payment and arrangements for payments received in the meantime. The IBAN, account holder and reference must be communicated through official channels when bank transfer is active.
The total due and any conditions of the selected method must be presented before the contract is concluded. Banking authentication codes, PINs and card security codes are never requested by email.
Proposal for validation: delivery by carrier within mainland Portugal. Shipping to Madeira, the Azores or other countries only after prior confirmation of availability, costs and applicable requirements. Carrier: to be specified by the client.
Proposal for validation: preparation within one to two working days after payment confirmation, and estimated delivery within two to five working days after dispatch to mainland Portugal. These times are a commercial model and must be adapted to actual operations.
Shipping charges must be calculated and displayed before purchase, according to destination, weight or quantity. Shipping charges and any free-shipping threshold: to be determined. No free shipping is assumed in this version.
Unless otherwise agreed, goods must be delivered without undue delay and, as a rule, within 30 days of the contract being concluded. In the event of non-performance, the consumer may allow an appropriate additional period and, if delivery is still not made, terminate the contract. In circumstances provided for by law, particularly refusal to deliver or an essential delivery deadline, termination may occur without an additional period.
On receipt, we recommend checking the packaging and, if there is visible damage, recording it with the carrier and contacting us, preferably with photographs and the order number. This recommendation does not create a time limit for claims or restrict statutory rights.
The risk of loss or damage passes when the consumer, or a third party designated by them other than the carrier, takes physical possession of the goods, subject to statutory exceptions concerning a carrier independently chosen by the consumer.
If you receive an incorrect, damaged or non-conforming item, contact us for assessment and a remedy at no cost in accordance with the law. Do not consume food or beverages whose safety is in doubt.
You may request cancellation at carlosimoes.terrasdagama@gmail.com, quoting the order number. Proposal for validation: accept requests received before dispatch free of charge and refund through a method equivalent to the payment, without prejudice to statutory rights and time limits.
If the order has already been dispatched, the applicable return and withdrawal options will be explained. A cancellation request does not remove or restrict the statutory right of withdrawal.
For distance purchases covered by this right, consumers have 14 consecutive days to withdraw from the contract without giving a reason. The period starts when the consumer or their designated third party, other than the carrier, takes physical possession of the goods; for an order delivered separately, it starts on receipt of the last item.
Simply send an unequivocal statement of your decision within that period, for example by email to carlosimoes.terrasdagama@gmail.com or by letter to the stated address. You may use the form below, but this is not mandatory. Keep proof of sending.
After notifying withdrawal, you must return the goods without undue delay and within 14 days of that notification. Proposed returns address, to be confirmed: Rua de São Bartolomeu n.º 14, 6120-030 Vale da Gama. Exercising the right does not require prior authorisation.
Commercial proposal: the consumer bears the direct costs of a return following withdrawal, provided they were informed before purchase. If that information was not provided, the statutory consequences apply. Returns due to errors or non-conformity are not treated as a simple change of mind.
Consumers may inspect the nature, characteristics and functioning of the product. They are liable only for diminished value resulting from handling beyond what is necessary for that inspection, in accordance with the law. Original packaging is recommended for protection but is not a general condition for exercising the right.
The right of withdrawal may not apply, among other circumstances provided for by law, to goods liable to deteriorate or expire rapidly, personalised products, and sealed goods unsuitable for return for health protection or hygiene reasons once opened after delivery.
These exceptions are assessed according to the specific nature of the product. Food, wine bottles and honey jars are not automatically excluded solely because of their category. Any applicable exception must be communicated before purchase.
Exceptions to withdrawal do not affect rights relating to damaged, incorrect, unsafe or non-conforming products.
In the event of withdrawal, payments received, including the cost of standard delivery, will be refunded within 14 days of notification of the decision. Any additional cost of a more expensive delivery method chosen by the customer need not be refunded.
Where legally permitted and unless collection is offered, the refund may be withheld until the goods are received or proof of return is provided, whichever occurs first.
Refunds are made using the same payment method unless expressly agreed otherwise and at no cost to the consumer. For other grounds for termination or unavailability, the respective statutory periods and rules apply.
Products must conform to the contract and meet legal requirements. Portuguese Decree-Law No. 84/2021 generally provides for the trader's liability for a lack of conformity in movable goods that becomes apparent within three years of delivery.
For food and beverages, this protection must be assessed in light of the nature of the goods, their characteristics, shelf life and storage conditions. It does not mean that a perishable product has a three-year shelf life, nor does it remove liability for defects present at delivery.
Where goods lack conformity, consumers are entitled to statutory remedies, including repair or replacement, price reduction or termination, under the conditions prescribed by law. If the lack of conformity becomes apparent within the first 30 days after delivery, immediate replacement or termination may be requested in accordance with the law.
